Use of geographic names in the registration of trademarks

By the Resolution of the Presidium of the Intellectual Property Rights Court (SIP) dated 12.09.2019 No.SP-21/31 taken into account Review of CIP practice on issues related to the use of geographic names in trademark registration.

The review contains clarifications regarding the assessment of the perception of the designation as an indication of the place of production of the goods or the location of the manufacturer from the point of view of consumers, as well as in relation to situations of (non) coincidence of the location of the copyright holder (applicant) with the geographical name included in the composition of the trademark (designation applied for registration), and (not) recognition of the geographical name in the designation as false.
