Prior to using this designation, we advise checking to see whether it has been registered as a trademark or whether an application has been submitted for registration as a trademark. This applies not only to words and pictures, but also to slogans, forms of packaging and even colors (for example, turquoise is the trademark of a well-known foreign company registered in the Russian Federation for jewelry and some other goods and services).
Tip. It is worth noting that if a designation is not registered as the trademark or has not been submitted for registration, this does not mean that the designation is available for use. For example, it can be used by another company for a long time or be registered as an industrial design. Signs should be carefully checked to reduce risks.
For whom
Searching for registered trademarks or applications for their registration is relevant for all entities who plan to use a new designation for their goods and/or services (for those who are introducing a new brand). This is a preliminary step before registering a designation as a trademark. However, even if the designation is not planned to be registered as a trademark, a search will help the business to minimize the risks associated with the violation of the rights of third parties.
